USN Terms
The www.usnireland.ie website ("the Website") is the property of USN
in Ireland Ltd ("USN"). Registered company number 387398. By accessing
any part of the Website and/or purchasing any goods through the
Website, you shall be deemed to have accepted this legal notice
in full and you agree to be bound by the following terms and conditions.
1. Content
1.1 USN has taken reasonable care in the preparation of the content of the Website. However, to the extent permitted by applicable law, USN disclaims all warranties (express or implied) as to the accuracy of the information contained in any of the materials on the Website.
1.2 USN shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the materials on the Website.
1.3 Certain links in the Website (typically a banner advert or icon) will lead to sites which are not under the control of USN. When you activate any of these you will leave the Website and USN has no control over and will accept no responsibility or liability for the material on any site which is not under the control of USN. Links to a third party website on the Website are provided solely for your convenience. If you decide to access any of the third party websites linked to the Website, you do so entirely at your own risk.
2. Products and Pricing
2.1 Products may be withdrawn for sale from the Website at any stage without any prior notification. We also reserve the right to amend prices of products without prior notification. All prices on the Website are in Euro, and that is what will be deducted from your debit/credit card. If you are purchasing using a non-Euro credit card (e.g. sterling) the exchange rate is applied by your bank and not by USN.
2.2 In the event a product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we shall have the right to refuse to meet or to cancel any orders placed for that product or service whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your credit card account in the amount of the charge.
3. Ordering
Once you have entered your personal details including debit/credit card information, and have proceeded past the checkout stage of the purchase process, it is deemed that you wish to purchase the product or products in the shopping cart. It is also assumed that you wish to have your debit/credit card deducted accordingly.
4. Delivery
4.1 Products are delivered on the premise that they are for your own personal consumption, and not for re-sale. Delivery times quoted are estimates only, and USN shall not be liable for any delays caused except to the extent caused willfully or negligently by USN. Delivery times will normally be up to 2 days for delivery to Republic of Ireland and up to 7 days for all other countries. In the unlikely event that the item you ordered is not in stock, we will contact you and let you know the expected delivery date. If you decide not to pursue with your order, we will cancel the order and issue a full refund.
4.2 If you order products on the Website, and your delivery address is outside of Ireland, these products may be subject to import taxes/duties imposed by the relevant country of residence of the customer. USN have no control over the imposition and rates of these taxes and cannot predict their amount, or pre-charge them. Therefore, these duties are your responsibility. It is advisable to contact your local customs office for further details.
5. Safe Payments
5.1 We want to reassure you that when you shop on the Website, you can do so with complete confidence. When you purchase from us, you give us some personal information, such as your name and address, in order for us to fulfil your order. We will never, ever share these details with any other party. We will only contact you if there is a problem with your order, or if you have agreed to receive marketing materials.
5.2 If our privacy policy changes, we will amend the Website and privacy policy accordingly. You will be given the option to subscribe to our mailing list where we may contact you for marketing purposes. We will never pass these details on to any external third party, unless we have specific permission from you to do so. We reserve the right to pass on personal data if the business is sold.
6. Returns Policy
6.1We understand that from time to time, a product may not reach you in the condition you had expected it. If for some reason you wish to return the product, please contact us by email first within 10 working days of purchase at info@usn.com stating the reason for return. We will issue a replacement product or a full refund for the wrong item being dispatched by us (once we receive the returned product). We will take postage and packaging charges into account.
6.2 Returns for any other reason will receive a refund (once we receive the returned product). The cost of postage and packing in this instance must be borne by the customer.
6.3 All returns must reach us by 20 working days of receiving your order. Items must be unused and unopened. The original packaging and labelling must still be attached. These conditions do not affect your statutory rights as a consumer.
6.4 If a refund is deemed necessary, we can only refund the debit/credit card which was used originally for purchase.
7. Liability
7.1 USN or any other party (whether or not involved in creating, producing, maintaining or delivering the Website), and any of USN's group companies and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the Website in any way or in connection with the use, inability to use or the results of use of the Website, any websites linked to the Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the Website or your downloading of any material from the Website or any websites linked to the Website.
7.2 Nothing in this legal notice shall exclude or limit USN's liability for death or personal injury caused by our negligence or any person for which we are responsible
8. Copyrights
All designs, text, graphics and their selection and arrangement on the Website are the copyright of USN or its content providers. As a visitor to the Website you are licensed to copy electronically or to print portions of the Website for your own personal, non-commercial use. Any other use of materials on the Website without USN's prior written consent is strictly prohibited.
9. Indemnity
You shall indemnify USN and any third party (including its sub-contractors) from and against any liability, losses, rights, expenses, loss of profits, business interruption, consequential loss, pecuniary loss, claims or legal proceedings, including, but not limited to claims involving defamation and intellectual property infringement, and expenses, including legal fees, arising from your use of the Website or purchase of goods and/or services from the Website which are brought or threatened against USN or suffered or incurred by USN by another person or entity.
10. Medical Information
10.1 The information on the Website should be used for guideline purposes only and should not be considered as medical advice or used to self-diagnose. If you are taking medication of any kind, it is best to check with a qualified medical practitioner before you purchase products from the Website for a diagnosed condition.
10.2 Moreover, it is hereby stated that products on the Website are not to be purchased to cure any disease or ailment.
10.3 It is important that you read and understand the label of any product you purchase from the Website before consumption. The onus is on the customer to ensure they are satisfied to consume the purchased product.
11. Matters Beyond our Reasonable Control
USN shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire, lightening, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other competent authorities.
12. Place of performance and applicable law
USN is a company registered in Ireland. Unless otherwise specified, the materials on the Website are directed solely at those who access the Website from Ireland. Those who choose to access the Website from other locations are responsible for compliance with local laws. Irish law shall govern this Agreement and the parties submit to the exclusive jurisdiction of the Irish courts in relation to disputes arising out of this Agreement.
13. Severability
In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.
